November 5, 2007

A Regular Meeting of the City Council, the Community Development Agency, the Community Development Financing Authority, the Public Improvement Corporation, and the Library Board of Trustees of the City of Mission Viejo, California, was called to order by Mayor Reavis at 5:01 pm, on November 5, 2007, at 200 Civic Center, Mission Viejo, California.

A complete copy of the agenda for the meeting containing all items as shown herein was posted by 5:00 p.m. on October 31, 2007, on the outdoor bulletin board at City Hall. Copies were also posted at the Montanoso Recreation and Fitness Center, 25800 Montanoso Drive, and the Norman P. Murray Community and Senior Center, 24932 Veterans Way.

RECESS TO CLOSED SESSION AND RECONVENE

Mayor Reavis recessed the meeting to Closed Session at 5:04 p.m. The City Council reconvened in open session at 6:00 p.m. with all five City Council Members present.

REPORT OF CLOSED SESSION

City Attorney Bill Curley announced that the City Council provided direction to staff but there was no reportable action from Closed Session.

PRESENTATIONS

City of Mission Viejo Housing Rehabilitation Program

The City Council received the presentation by Housing Rehabilitation Specialist Theresa Dobbs.

PUBLIC COMMENTS

Randall Lawson, M.V.: expressed concern with parking issues that continue on Via San Pedro, Via San Felipe and Via Alvorado. Mayor Reavis asked Mr. Lawson to present his comments when the item is removed from the Consent Calendar for discussion (item #18).

Mickey Schulte, M.V.: requested that the City Council reorder the Agenda and address items 40 and 41 earlier in the evening.

Sandy Hill, M.V.: Discussed the Trauma Intervention Program (TIP), provided a brief update on their assistance to victims of the recent fires, and outlined upcoming TIP events.

Cathy Schlicht, M.V.: stated that this City Council has turned its back on open and honest government.

Connie Lee, M.V.: stated that Developers are running and ruining Mission Viejo and that residents don’t want additional housing and diminished property values.

8. Cabot-Camino Capistrano Bridge Improvements (CIP 782)
Approved Change Order 1 to Purchase Order 050251 to RBF Consulting, Inc., for additional preliminary design services in the amount of $46,776.

9. Consulting Services Associated with the Transportation Corridor Agencies and the City of Mission Viejo
Authorized staff to issue a purchase order to RBF Consulting, Inc., (Design Team Contract DT-51) for professional consulting services associated with ongoing Transportation Corridor Agencies issues in an amount not to exceed $42,000.

10. Purchase of Citywide Internet Services.
Approved a three-year contract with AT&T for $84,672 for Internet services (A07-90).

11. Community Services Funding Program - Funding for Fiscal Year 2007-2008
Approved the Community Services Commission's recommended funding amounts for Fiscal Year 2007-2008 for the Community Services Funding Program.

12. Relocation of City Data Center from Library to City Hall
Adopted Resolution No. 07-62 Amending the FY 2007-08 Budget to Provide Funding for the Relocation of the City’s Data Center from the Mission Viejo Library to the City Hall.

13. Use of City Manager’s Credit Card
Authorized the one-time use of the City Manager's corporate credit card for Red Ribbon Week Grand Marshal travel expenses.

14. Annual Review of Residential and Commercial Integrated Waste Management Rates
Adopted Resolution 07-63 Authorizing Annual Rate Adjustments For Solid Waste Collection Services To Become Effective On January 1, 2008.

15. Mission Viejo Library’s One-Year Subscription to InfoTrac
Authorized the issuance of a purchase order to Califa in the amount of $42,132.00 for a one-year subscription renewal (July 1, 2007 to June 30, 2008) to InfoTrac’s General Reference Center Magazine Database, the Business and Company Resource Center Database, the Biography Research Center Database, the Literature Resource Center Database, and the Opposing Viewpoints Database.

16. Marguerite Recreation Center Renovation (CIP 992) - Rehabilitation of the Pool Area
(1) Approved change order No 2 to California Commercial Pools, Inc. in an amount not to exceed $25,186.00; (2) approved change order No. 1 to Friess Construction, Inc. in an amount not to exceed $7,691.00; (3) approved change order No. 1 to Petra Geotechnical, Inc. in an amount not to exceed $1,680.00; (4) adopted Resolution 07-64 Amending the FY 2007-08 Budget to Appropriate Funds for the Rehabilitation of the Marguerite Recreation Center; (5) authorized the City Clerk to record Notice of Completion with the County of Orange and to release the faithful performance and payment bonds one year and 35 days respectively after the date of recordation of the notice of completion contingent upon no claims or liens being filed with or by the City; and (6) authorized payment of the final retention 35 days after the date of recordation of the notice of completion.

17. YMCA Parking Lot (CIP 315)
Approved the plans and specifications for the rehabilitation of the parking lot at the Marguerite Recreation Center

19. Norman P. Murray Community and Senior Center Room Rental Rates and Facility Regulations
Approved (1) the Community Services Commission's recommendation for Room Rental Rates and Facility Regulations; and (2) allowing alcohol at the Norman P. Murray Community and Senior Center.

21. Marguerite Tennis Center Court Lighting (CIP 310), Marguerite Tennis Center Renovation (CIP 501) and Montanoso Locker Rooms Renovation (CIP 500)
Awarded the construction management contract for the design and preconstruction phase for the Marguerite Tennis Center Court Lighting (CIP 310), Marguerite Tennis Center Renovation (CIP 501) and Montanoso Locker Rooms Renovation (CIP 500) projects to Friess Construction, Inc. in an amount of $56,500 (A07-92).

22. KSBR Jazz FM 88.5 of Saddleback College 2008 Birthday Bash Co-Sponsorship
1) Approved City Co-Sponsorship of the KSBR Jazz FM 88.5 of Saddleback College 2008 Birthday Bash; and (2) approved a Special Events Permit for Sunday, May 25, 2008 at the Norman P. Murray Community and Senior Center and Oso Viejo Park.

23. Employee Compensation Package for Calendar Years 2008 and 2009
(1) Adopted Resolution 07-65 Amending the City’s Salary Schedule and Establishing Salary Ranges for Authorized Job Classifications; (2) adopted Resolution 07-66 Restructuring the City’s Flexible Benefit Plan and Fixed Monthly City Contribution Schedule; (3) approved a 1%-of-base-salary City contribution for all full-time equivalent at-will, regular, promotional probationary, and probationary employees to a deferred compensation program; and (4) authorized the City Manager to secure a California Public Employees’ Retirement System (CalPERS) valuation and contract amendment for the Pre-Retirement Optional Settlement 2 Death Benefit.

24. Computer Network Cabling for the Library Building.
Waived bidding requirements per Municipal Code Section 3.12.290 (7) and approved contract with PacifiCom (A07-93) in the amount of $66,500 for purchase of cabling services and materials.

25. Norman P. Murray Community and Senior Center Expansion (CIP 994)
Approved Change Order #13 to Douglas E. Barnhart, Inc. in the amount of $181,665 for additional construction costs for subject project.

26. Request to Close the Mission Viejo Library on Sunday, November 11, 2007
Approved the request to close the Mission Viejo Library on Sunday, November 11, 2007, to facilitate the relocation of City Data Center from the Mission Viejo Library to City Hall

27. Summary of FY 2007-08 Budget Amendments To Date
Received and filed.

40. Update and Discussion Regarding Casta Del Sol Golf Course
City Council Member Ury asked staff to provide a report on the communications that have circulated on this matter and asked for public testimony.

41. Casta del Sol Golf Course
Mayor Reavis stated that she has placed this item on the Agenda in order to initiate a full public discussion with the City Council regarding the status of Casta del Sol Golf Course and to determine if the Council wishes to direct staff or the Council to pursue any action such as San Clemente has taken regarding conversion of a portion of a golf course in their city.

Appeal of Planned Development Permit PDP2007-188 Filed by Mayor Gail Reavis of the Planning and Transportation Commission’s September 24, 2007 Conditional Approval of a Petition Submitted by Amit Patel of Aspen Associates, Agent for T-Mobile, to Construct a Wireless Telecommunication Facility at a Moulton Niguel Water District Site at 26451 Lope De Vega Drive, in the R (Recreation) zone
Director of Community Development Chuck Wilson presented the staff report.

Director of Public Services Keith Rattay answered questions of the City Council in relation to landscaping and screening issues at the site.

Joe Thompson, T-Mobile: discussed extra expenses associated with landscaping and potential repair of a retaining wall. Asked the City Council to deny the appeal.

Mayor Reavis opened the public hearing.

Joe Thompson, T-Mobil: provided rebuttal comments and stated that the landscaping requirements are unreasonable.

Motion made by Council Member Ury, seconded by Council Member MacLean, to (1) adopt Resolution 07-67 Denying the Appeal Filed by Mayor Reavis, and Thereby Approving Planned Development Permit PDP2007-188, and (2) modify the landscape component to require T-Mobil to submit $15,000 to the City for landscaping upgrades, including retaining wall improvements, as directed and approved by the City of Mission Viejo and in unison with Moulton Niguel Water District landscape upgrades to the property.

Motion made by Council Member Kelley, seconded by Mayor Pro Tempore Ledesma, to (1) introduce Ordinance 07-262 Adopting by Reference the 2007 California Fire Code, Incorporating the International Fire Code 2006 Edition, With Errata, Including Appendices Chapter 1 A, B and C, and the referenced standards together with certain amendments and deletions”; and (2) adopt Resolution 07-69 Scheduling a Public Hearing for December 3, 2007 and Directing the City Clerk to Cause Notice Thereof To Be Published in Accordance with Government Code Section 50022.3.

Matthew Levenson, Nine Star Inc., M.V.: summarized his request for a skateboard and bike demonstration area at the exterior of the Nine Star retail store in the Kaleidoscope Center.

Motion made by Mayor Pro Tempore Ledesma, seconded by Mayor Reavis, to (1) adopt Resolution 07-70 Approving the Appeal Petition and Approving Minor Modification MM2006-125 Submitted by Matthew Levenson of Nine Star, Inc. for a 500 Sq. Ft. Skateboard and Bike Demonstration Area at the Exterior of Nine Star Action Sport Retail Business Located at Kaleidoscope, 27741 Crown Valley Parkway, in the CH (Commercial Highway) Zone; and (2) add Condition 13, requiring that the demonstration area enclosure be extended to the ceiling for noise mitigation.

Cathy Schlicht, M.V.: expressed opposition to adoption of the ordinance and stated that the Planning and Transportation Commission did not include information from collision reports, volume, driveways and traffic lights in their recommendation.

Discussed her attendance at a recent Proposition 84 workshop where she learned about opportunities for grant funding available for City parks. Complimented Police Services and City staff on a very successful Walk Against Drugs on October 20th. Thanked firefighters for their heroic efforts in the recent fires and reminded residents that there will be a special opportunity on Sunday, November 11, 2007, to remember Veterans who have served our country and those who are currently serving. She also paid special thanks to City employee Christian Murdock who has been called back to active military duty. Announced that the City sent a letter to the Capistrano Unified School District asking that they carefully prioritize Mission Viejo projects and stated that she hopes the Board will allocate additional Measure A funding for Mission Viejo projects at their Board meeting tonight.
