PUBLIC COMMENT PROCEDURE

Any person wishing to address the Commission on any matter, either under the Public Comments section of the Agenda or scheduled items or public hearings, must fill out a “Request to Speak” form available at the door. The completed form must be submitted to the Secretary prior to the Agenda item being called by the Chairperson. In speaking to the Commission, members of the public shall be limited to three minutes per person, except for the applicant for entitlement. The Commission may establish an overall time limit for comments on a particular Agenda Item. Members of the public must direct their questions to the Chairperson of the Commission and not to other members of the Commission, the applicant, the Staff, or the audience.

PUBLIC COMMENTS – NON AGENDA MATTERS AND AGENDA MATTERS OTHER THAN PUBLIC HEARINGS

This is the time for members of the public to address the Commission on matters, which are on the Commission’s consent calendar or on matters, which do not appear on the Commission’s Agenda. Under state law, no action can be taken on comments from the public if the matter is not on the Commission’s Agenda unless the Commission makes a determination that (1) an emergency exists or (2) that the need to take action arose after the posting of the Agenda and that action must be taken before the next regular meeting of the Commission. There shall be an overall time limit of 15 minutes for the Public Comments portion of the Agenda unless the Commission makes a decision to extend the time period.

CONSENT CALENDAR

All matters listed under the Consent Calendar are considered to be routine and all will be enacted by one roll call vote. There will be no separate discussion of these items unless members of the Commission that request specific items be removed from the Consent Calendar for separate action.

Recommended Action: Approve Minutes.

2. Status Report Planning and Transportation Commission Matters
Recommended Action: Receive and file report.

PUBLIC HEARINGS

3. Conditional Use Permit CUP2010-284, being a petition submitted by submitted by Robert Hagopian and Brian Smith of the Meat House, to permit a Type 20 License (Off-sale beer and Wine) and a Type 42 License (On-Sale beer and Wine Consumption) in conjunction with a proposed 4,890 square foot specialty grocery store/ butcher shop at 23982 Alicia Parkway, Gateway Center, in the CN (Commercial Neighborhood) zone. The proposed store will offer a wide variety of meats and produce, unique varieties of beer and wine, and artisan cheeses.
Procedure: Staff report; public hearing; discussion and determination.
Recommended Action: Adopt resolution approving CUP2010-284.

4. Conditional Use Permit CUP2010-285, being a petition submitted by Veronica Schroyer to permit a Type 41 License (on-sale beer and wine) in conjunction with a proposed 2,988 square foot “Caf‚ Mia Terra” Italian restaurant at 25542 Jeronimo Road, Suite 1 (formally House of Kabobs), Silverado Plaza, in the CN (Commercial Neighborhood) zone.
Procedure: Staff report; public hearing; discussion and determination.
Recommended Action: Adopt resolution approving CUP2010-285.

OLD BUSINESS

5. Minor Modification MM2009-190, being a petition submitted by Eric Meurs of Plancom Inc., agent for Verizon Wireless, to modify a previously approved wireless telecommunication facility on the rooftop of an existing Ayres Suites hotel, 28941 Los Alisos Boulevard, in the CH (Commercial Highway) zone. The proposed modification involves adding three additional antennas and a new equipment cabinet to the existing Verizon facility. The current facility has equipment cabinets located at the center of the roof, and three sectors of panel antennae; two within a rooftop cupola and one within a radiofrequency (RF) transparent box wall-mounted high on the south wall and painted to match the existing building. The proposed antennas will be screened from view by the existing rooftop structures, parapets, and RF transparent box. (Continued from May 10, 2010 meeting)

Recommended Action: Adopt resolution approving MM2009-190.

NEW BUSINESS

6. Minor Modification MM2009-200, being a petition submitted by Patrick Inkmann of Cortel, LLC, agent for Sprint Nextel / Clearwire, to modify a previously approved wireless telecommunication facility at an existing Moulton Niguel water tank facility 26433 Ganiza, in the CF (Community Facility) zone. The proposed modification involves adding three additional panel antennas, three microwave dishes, and one new equipment cabinet to the existing Sprint Nextel facility. The Sprint Nextel facility consists of three sectors of panel antennas mounted to the side of the existing water tank. The modified facility will provide broadband high speed internet service to the surrounding community. This facility is a co-location with an existing T-Mobile facility.

Recommended Action: Adopt resolution approving MM2009-200.
