PUBLIC COMMENT PROCEDURE

Any person wishing to address the Commission on any matter, either under the Public Comments section of the Agenda or scheduled items or public hearings, must fill out a “Request to Speak” form available at the door. The completed form must be submitted to the Secretary prior to the Agenda item being called by the Chairperson. In speaking to the Commission, members of the public shall be limited to three minutes per person, except for the applicant for entitlement. The Commission may establish an overall time limit for comments on a particular Agenda Item. Members of the public must direct their questions to the Chairperson of the Commission and not to other members of the Commission, the applicant, the Staff, or the audience.

PUBLIC COMMENTS – NON AGENDA MATTERS AND AGENDA MATTERS OTHER THAN PUBLIC HEARINGS

This is the time for members of the public to address the Commission on matters, which are on the Commission’s consent calendar or on matters, which do not appear on the Commission’s Agenda. Under state law, no action can be taken on comments from the public if the matter is not on the Commission’s Agenda unless the Commission makes a determination that (1) an emergency exists or (2) that the need to take action arose after the posting of the Agenda and that action must be taken before the next regular meeting of the Commission. There shall be an overall time limit of 15 minutes for the Public Comments portion of the Agenda unless the Commission makes a decision to extend the time period.

CONSENT CALENDAR

All matters listed under the Consent Calendar are considered to be routine and all will be enacted by one roll call vote. There will be no separate discussion of these items unless members of the Commission that request specific items be removed from the Consent Calendar for separate action.

2. Status Report Planning and Transportation Commission Matters
Recommended Action: Receive and file report.

PUBLIC HEARINGS

3. Planned Development Permit PDP2010-225 and Variance VAR2011-40, being petitions submitted by Michelle Felten of Core Communications Group, agent for Verizon Wireless, to construct a wireless telecommunications facility at 24501 Marguerite Parkway, Jeronimo Commercial Center, in the CN (Commercial Neighborhood) zone. The proposed facility will consist of a 49’-2” tall freestanding tower structure housing 12 new panel antennas and one global positioning system (GPS) antenna. The proposed tower structure will be located on a landscape island within the parking lot at the same location as an existing freestanding kiosk. The applicant will demolish the kiosk if the subject application is approved. In addition, proposed radio equipment will be located within an existing vacant suite at the adjacent one story commercial building. Variance VAR2011-40 was filed to increase the height of the tower structure above the 35-foot height limit for the Commercial Neighborhood zone. The proposed facility will be a co-location with a future second wireless carrier.
Procedure: Staff report; public hearing; discussion and determination.
Recommended Action: Adopt resolution approving PDP2010-225 and VAR2011-40.

4. Planned Development Permit PDP2011-238, being a City initiated petition submitted by the City of Mission Viejo Public Services Department for the development of a dog park on approximately 6 gross acres of vacant land generally located to the south of James G. Gilleran Park on the easterly side of Felipe Road, between Tamarind and Fieldcrest. The site is further referenced as a portion of Assessor Parcel Number APN 786-601-05. The proposed dog park will provide three separate areas for dogs to run off-leash as follows: 1) large dogs will have a fenced area that totals approximately 1.4 acres; 2) small dogs will have a fenced area that totals approximately 0.6 acres; and 3) a separate fenced area that totals approximately 0.1 acres will be provided for people that want an area for their dog to exercise by itself. In addition to the three dog exercise areas, the proposed project includes surface parking for 42 cars, a pedestrian walking trail around the perimeter of the dog park, landscaping throughout the park and the building pad slopes, low-level safety and security lighting, bench seating with shade canopies, three drinking fountains, and split rail and chain link fencing. The east half of the proposed dog park, which comprises approximately 2.71 acres, is located in the County of Orange, and the remainder is in the City of Mission Viejo. The 2.71 acres of County of Orange property will be annexed into the City of Mission Viejo by the Local Agency Formation Commission (LAFCO) if the project is approved. The City of Mission Viejo property is located in the R (Recreation) zone.

Recommended Action: Adopt resolution adopting Mitigated Negative Declaration for proposed project (PDP2011-238).
