PUBLIC COMMENTS - NON AGENDA MATTERS AND PUBLIC HEARINGS
Any person wishing to address the Commission on any matter, either under the Public Comments section of the Agenda or scheduled items or public hearings, must fill out a “Request to Speak” form available at the door. The completed form must be submitted to the Secretary prior to the Agenda item being called by the Chairperson. In speaking to the Commission, members of the public shall be limited to three minutes per person, except for the applicant for entitlement. The Chairperson may establish an overall time limit for comments on a particular Agenda Item. Members of the public must direct their questions to the Chairperson of the Commission and not to other members of the Commission, the applicant, the Staff, or the audience.

PUBLIC COMMENTS - AGENDA MATTERS OTHER THAN PUBLIC HEARINGS
This is the time for members of the public to address the Commission on matters, which are on the Commission’s consent calendar or on matters, which do not appear on the Commission’s Agenda. Any person wishing to address the Commission on these matters must fill out a “Request to Speak” form available at the door. The completed form must be submitted to the Secretary prior to the Agenda item being called by the Chairperson. Under state law, no action can be taken on comments from the public if the matter is not on the Commission’s Agenda unless the Commission makes a determination that (1) an emergency exists or (2) that the need to take action arose after the posting of the Agenda and that action must be taken before the next regular meeting of the Commission. There shall be an overall time limit of 15 minutes for the Public Comments portion of the Agenda.

CONSENT CALENDAR

All matters listed under the Consent Calendar are considered to be routine and all will be enacted by one roll call vote. There will be no separate discussion of these items unless members of the Commission that request specific items be removed from the Consent Calendar for separate action.

PUBLIC HEARING

3.GENERAL PLAN AMENDMENT GPA2007-26, ZONE CHANGE ZC2007-18, AND DEVELOPMENT CODE AMENDMENT DCA2007-10
City-initiated petitions to modify the City’s adopted General Plan Land Use Element, General Plan Housing Element, and Zoning Map land use designations as it pertains to four properties further described below as Site A, Site B, Site C, and Site D.

Site A is a 2.74-acre vacant parcel located within and to the east of the Mission Foothill Marketplace shopping center at 28715-28841 Los Alisos Boulevard (Assessor Parcel No. 839-161-07). The General Plan Amendment proposes redesignation of the site from Commercial Highway to Residential 30 (14.0 - 30.0 dwelling units per acre). The Zone Change proposes redesignation of the site from the CH (Commercial Highway) zone to the RPD 30 (Residential Planned Development) zone, which is defined as a maximum of 30 dwelling units per acre.

Site B is a 7.12-acre parcel adjacent to Oso Parkway at Montanoso Drive that is owned by Mission Country Club (portion of Assessor Parcel No. 761-071-93). The General Plan Amendment proposes redesignation of the site from Recreation/Open Space to Residential 30 (14.0 - 30.0 dwelling units per acre). The Zone Change proposes redesignation of the site from the R (Recreation) zone to the RPD 30 (Residential Planned Development) zone, which is defined as a maximum of 30 dwelling units per acre.

Site C is an 8.5-acre area located on City-owned land directly adjacent to and southeasterly of the City’s animal Services Center off Center Drive, and easterly of Saddleback College (Assessor Parcel No. 740-112-03). The General Plan Amendment proposes redesignation of the site from Recreation/Open Space to Residential 30 (14.0 - 30.0 dwelling units per acre). ). The Zone Change proposes redesignation of the site from the R (Recreation) zone to the RPD 30 (Residential Planned Development) zone, which is defined as a maximum of 30 dwelling units per acre.

Site D is an 8.5 acre developed parcel located at 27071 Cabot Road at the southerly portion of the Saddleback Technology Park (Assessor Parcel No. 636-022-14). The General Plan Amendment proposes redesignation of the site to a Mixed Use designation to allow for the flexibility to combine residential with non-residential uses in the same building or project area. The Development Code Amendment creates a Mixed Use Overlay Zone category in the City’s Development Code and defines allowable land uses and property development standards, including intensity of development, for mixed-use areas. The Zone Change adds a Mixed Use Overlay Zone designation on the subject property providing flexibility for mixed use development of the site. The underlying zoning of the site, BP (Business Park/Industrial), will remain in place.

Procedure:Staff report; public hearing; discussion and determination.
Rec. Action:Adopt resolution recommending to City Council approval of GPA2007-27, ZC2007-18, and DCA2007-10.
